Presidium and Alternates
The Arbitration Board is affiliated with a Presidium consisting of a chair, a vice-chair, and one additional member, as well as 19 alternates, in accordance with the Arbitration Board's statutes. These judges form the judicial panel. The judges are either Supreme Court justices or High Court judges, appointed by the President of the Supreme Court. The names can be found below. The composition of the Arbitral Tribunal
An arbitral tribunal consists of three members, namely one legal judge and two expert judges, but it can also consist of five members or just one member. In simplified arbitration, the parties can choose two judges. If the arbitral tribunal appointed by the Arbitration Board consists of more than one member, the chair will be selected from the members of the Presidium and alternates, meaning that the chair will be a legal judge. The legal judge is appointed by the chair of the Presidium. If a case is to be heard by one arbitrator only, the arbitrator may be either a legal or a technical arbitrator. The expert judges are appointed by the Arbitration Board based on the specific area of expertise related to the dispute. This applies whether one or two expert judges are appointed for a three-member or five-member tribunal. In selecting the expert judges, factors such as professional competence, experience, and the key issues of the case are taken into consideration.
Special circumstances
In special cases, the chair of the Presidium may appoint one or more current or former judges from the Supreme Court or the High Courts, or other legal professionals who meet the requirements to be appointed as judges, to participate in the handling of individual arbitration cases. The chair will also decide who should serve as the chair of the arbitral tribunal in such cases.
The chair of the Presidium has issued guidelines to the Secretariat concerning the procedures to be followed when appointing legal arbitrators for arbitral tribunals, including guidelines for Secretariat recommendations for appointment
In large-scale or principal cases, a Supreme Court judge is often appointed as the chair of the arbitral tribunal.
When a High Court judge is appointed as the chair of an arbitral tribunal, a judge from either the Eastern or Western High Court is generally chosen, depending on the location of the subject matter of the case—i.e., within the jurisdiction of the Eastern or Western High Court. However, for the sake of case efficiency, appointments may be made independently of the High Court jurisdictions.
According to the statutes of the Arbitration Board, retired arbitrators may complete cases already allocated to them. The following legal arbitrators continue to be attached to the Arbitration Board on this basis:
