For the handling of arbitration cases – including simplified arbitration – the Arbitration Board must be paid a fixed fee of DKK 3,000 or DKK 4,000, depending on the time the case is filed. The fee covers the costs associated with the initiation of the case and a service charge, which covers the administration of the case by the Arbitration Board. Additionally, an honorarium will be paid to the arbitral tribunal.
The service charge is determined based on a fixed percentage of the total value of the case, as outlined in the table in section C of the guidelines for calculating fees and service charges, etc. The value of the case is the amount of the claims made and may change up until the start of the main hearing. For the calculation of the service charge and honorarium, please use the cost calculator at the bottom of this page.
The fee must be paid regardless of whether the case is discontinued after a very short period. The full service charge is payable if the case is concluded with a main hearing or decided on a written basis, but a reduction in the service charge is applied if the case is settled or otherwise discontinued before the main hearing.
In cases that are settled or otherwise discontinued or rejected within the first 30 days after the case is initiated, only a fee is payable, and no service charge is due. This is provided that written notification is sent to the Board within 30 days after the submission of the statement of claim. The 30-day deadline can be suspended for up to 6 months if the parties provide written notice that settlement negotiations are ongoing.
A half service charge is only payable in cases that are settled or otherwise discontinued or rejected before receiving the reply. For larger cases, there is the additional advantage that the half service charge can be a maximum of DKK 100,000. If the case is settled after receiving the reply and no later than one week before the main hearing, the service charge will be reduced by 25%. There is no maximum for this amount. However, during a transition period, a maximum of DKK 200,000 applies for cases initiated before April 1, 2021. Thus, if the case is settled, for example, the day before or on the day of the main hearing, the full service charge is payable.
The service charge is a minimum of DKK 7,000.
The fees for the arbitral tribunal are determined based on the amounts outlined in Section B, Point 2, of the guidelines for calculating fees for arbitrators, etc. The starting point is the stated amount, which can be adjusted either upwards or downwards depending on the case's nature and scope, the number of meeting days, and the form of the decision. In the case of a settlement, the service fee is calculated based on the subject matter of the case, with possible deductions depending on the timing of the settlement.
If the subject matter of the case is DKK 500,000 or less, and the arbitral tribunal consists of only one arbitrator, the honorarium is, as a rule, DKK 25,000 for one day of the main hearing.
Expenses for meeting rooms, transportation for the arbitral tribunal, and possible hotel accommodation, etc., should also be anticipated.
If the case involves a claim under DKK 1 million with one arbitrator, the total costs can generally be kept within the deposit of DKK 40,000.

The arbitral tribunal's honorarium is calculated based on the amounts stated in the guidelines.
For the administration of the case, the Arbitration Board generally charges a fee of 38.5% of the arbitral tribunal's fee. If the case is settled or withdrawn before the oral hearing, a fee of 38.5% of the arbitral tribunal's fee is payable to the Arbitration Board, which, however, will be a minimum of DKK 7,000.

In cases with three arbitrators, the claim amount can be entered into the cost calculator, which on the basis of the claim amount can provide an estimate of the total cost of cases. The costs calculated are indicative only, which means that the final costs may be higher or lower depending on how the case develops and other expenses incurred.
The calculator is not accurate for the arbitral tribunal's fees in cases with only one arbitrator, as stated above. The calculator cannot be used in cases with a claim exceeding DKK 500 million.
The Arbitration Board recommends that parties in cases involving claims of less than DKK 500,000 consider whether it would be possible to use an arbitral tribunal with only one arbitrator, as the costs involved in the hearing of the case would otherwise be disproportionately high.

In determining the fees, consideration is given to the arbitral tribunal's total workload, including the complexity of the case, the number of meeting days, the value of the case, and the form of the decision.
The rental of meeting rooms in the Arbitration Board's meeting rooms on Vesterbrogade is DKK 4,000 for a large meeting room for one day and DKK 2,000 for a small meeting room, as well as DKK 3,000 for multiple small rooms in mediation or conciliation cases. Cancellations must be made at least 30 days before the meeting, after which the full rental fee is required, unless the meeting is held on another day. If the meeting is held at another location, the costs will be charged according to the invoice.
A rescheduling fee of DKK 5,000 is payable by the party requesting the rescheduling of the meeting. If the parties agree to the rescheduling, for example due to settlement negotiations, the cost will be shared between the parties. No rescheduling fee will be charged if the rescheduling is due to circumstances related to the arbitral tribunal or the Arbitration Board.
The parties are jointly and severally liable for all payments, but have recourse against the other parties.
Rules regarding security deposit and case costs are found below.
The determination of the costs to the arbitral tribunal can be separately brought before the courts by a party. The Arbitration Board's board of directors supervises the level of the arbitral tribunals' fees.

No fee or charge is payable at the time of submitting the statement of claim. At the start of the case, the Arbitration Board will determine and notify the amount of security to be provided for the costs of the arbitration proceedings, i.e., a deposit. The deposit is to be shared equally among the involved parties. The cited party must also pay the deposit as a party to the case. In the case of a citation where the defendant continues the claim in the form of an indemnity claim, the deposit will be charged to the cited party or parties in relation to the originally submitted payment claim.
As a general rule, DKK 40,000 is charged in cases with only one arbitrator and a claim under DKK 500,000. In cases with a claim exceeding DKK 500,000, the deposit will be determined based on the amount of the claim.

The parties may not submit a bank guarantee for payment of the costs when a statement of complaint is lodged at the Arbitration Board.
Upon conclusion of the case, the arbitral tribunal will decide how the costs of the case are to be distributed between the parties, after which the Arbitration Board will settle the case. Any excess deposit will be refunded in this regard. Interest accrued on the deposited amount will be retained by the Arbitration Board, and the board will bear any associated expenses.
To ensure quick and correct registration of payments and deposits at the Arbitration Board, the FIK code sent to the parties to the case when the complaint was filed should be used. Some Arbitration Board letters contain codes for both parties, and the names of the parties are clearly stated next to the relevant codes. Please use the correct FIK code. Some IT systems do not support the use of FIK codes, in which case payments can be made to the following account:

The Arbitration Board is not registered for VAT, so all fees and charges are exempt from VAT. If and when the Arbitration Board invoices services on which VAT must be paid – typically expenses related to expert appraisal – the VAT amount will be specified in the settlement letter.
