Voldgiftsnævnet overholder den til enhver tid gældende persondatalovgivning i Danmark.

Voldgiftsnævnets brugere har ret til at vide, hvilke oplysninger Voldgiftsnævnet har om dem, hvordan de bruges, og hvornår de slettes.

Når Voldgiftsnævnet på baggrund af parternes aftale anmodes om at bistå ved tvistehåndtering, f.eks. syn og skøn eller voldgift, oprettes en sag i Voldgiftsnævnet, hvor parternes og evt. advokaters navne samt kontaktoplysninger registreres. I sagerne opbevares den korrespondance og de dokumenter, der fremsendes af parterne, sammen med evt. skønserklæringer, afgørelser og kendelse i sagen.

Members of the Arbitration Board staff have access to all information in case files, but they are bound by a duty of non-disclosure, and all information is treated as confidential and is only passed on to the parties to the case or their representatives as well as any expert appraisers, arbitrators, etc appointed in the case.

The Arbitration Board has entered into a data processing agreement with its IT suppliers and others so as to ensure that applicable rules are observed in connection with the provision of IT support by technicians who have access to the Board’s IT system. In addition, the Arbitration Board has security measures in place to ensure safe storage of data.

Data on expert appraisers, specialists experts, etc

The Arbitration Board keeps data on expert appraisers, arbitrators, specialist experts, mediators, conciliators and others who are involved in the work of the Board in its IT system, and some data are passed on in individual cases, eg CVs, information about professional background and contact details. Such data will typically be data that the person in question has submitted to the Board in the form of contact details, CV, banking details and possibly also a civil registration number. Banking details and civil registration numbers are exclusively used in connection with payments and statutory reporting to the tax authorities and other public authorities.

Voldgiftsnævnet sletter automatisk sådanne oplysninger, når de pågældende ikke længere er tilknyttet Voldgiftsnævnet, og de kan til enhver tid anmode os om at slette dem. Dog kan der i visse tilfælde være behov for at gemme nogle oplysninger, fx i forhold til honorar, ligesom navne og kontaktoplysninger fortsat vil være tilknyttet sagerne og indgår i evt. afgørelser, herunder kendelser. Tidligere anvendt CV vil indgå i de konkrete sager.

Storage and deletion of case files

The Arbitration Board has no legal obligation to store concluded cases for a particular number of years or to delete them after a certain period of time. However, if data is stored there must obviously be a good reason for this being done.

The Arbitration Board is not bound by the rules that apply to government institutions, since the Board is a private enterprise.

Storage period

The Arbitration Board only stores cases in electronic form. Physical material is shredded immediately after the cases are concluded.

The storage period depends on the type of case. The Arbitration Board retains cases involving expert appraisal (A-cases) and arbitration cases (C- or R-cases) for 20 years after the case is concluded. Cases involving expert determination (G-cases), speedy resolution (O-cases), mediation or conciliation cases (P- and Q-cases), and informal dispute assesment (H-cases) are stored for 10 years. Cases where the Arbitration Board proposes an expert appraiser (B-cases) are stored for 5 years.

Der er ved opbevaringsperioden bl.a. lagt vægt på, at den findes nødvendig for at sikre en høj kvalitet i vores sagsbehandling og for kunne fremfinde tidligere sager og praksis, herunder for at undgå inhabilitet og interessekonflikt i øvrige sager.
